Terms of Sale

1. Seller and contact details

These General Terms of Sale (the “Terms”) govern the sale of Tiboo products through the website mytiboo.com (the “Site”). The seller is:

BYTE S.R.L.
Registered office: Via Casale 16, 10060 Scalenghe (TO), Italy
VAT number: IT12199130019
Email: support@mytiboo.com
PEC (certified email): byte-srl@pec.it

Returns address (to be used only after you have notified us of your withdrawal): BYTE S.R.L. – Tiboo Returns, Via E. Cravero 44, 10064 Pinerolo (TO), Italy.

Customer service replies by email, usually within two business days.

2. Scope

These Terms apply to all orders placed on the Site, both by consumers (individuals buying for purposes outside their trade, business, craft or profession, as defined by Article 3 of Italian Legislative Decree 206/2005, the “Consumer Code”) and by business customers. Clauses that apply only to consumers or only to business customers are expressly identified.

Before payment you are asked to read and accept these Terms. You can save or print them from this page at any time. The contract can be concluded in English or Italian; if the two versions differ, the version in the language in which you placed your order prevails.

3. Products

The Site sells:

The main characteristics of each product are described on the product page and summarised before payment. Products are 3D printed to order: slight differences in colour, finish and texture compared with the images are inherent in the production process and are not defects. Images show the prototype.

4. Prices, VAT and duties

Prices are in euros and include VAT where applicable. The shipping cost depends on the destination (Italy, European Union, outside the EU); it is shown on the Site and in the summary, together with the total amount, before you confirm payment.

For deliveries outside the European Union, any customs duties, import taxes and clearance fees are paid by the buyer. They are not included in the price and may be requested by the carrier or the authorities on delivery.

If a price is obviously wrong and clearly not a real price (for example, a manifestly tiny price caused by a technical error), we will contact you before shipping: you can confirm the order at the correct price or cancel it for a full refund.

5. Placing an order and conclusion of the contract

  1. On the Site you choose the configuration, the Shields, any extra quantities and the shipping zone.
  2. After accepting these Terms you are taken to Stripe’s secure payment page, where you enter your delivery, billing and payment details and see the full order summary.
  3. The contract is concluded when the payment is successfully completed. You will receive a confirmation with the order summary at the email address you provided.

We keep the order details; the version of the Terms that applies is the one published on the Site when you placed the order (version shown at the top). We may refuse or cancel an order, with a full refund within 14 days, if a product is unavailable, in case of suspected fraud or of an obvious pricing error.

6. Payment and invoices

Payment is taken when you place the order via Stripe (Stripe Payments Europe, Limited), using the methods shown on the payment page. Card data is handled exclusively by Stripe: BYTE S.R.L. does not receive or store full payment card details.

You will receive a payment receipt by email. Business customers can enter their VAT number and, for Italy, their SDI recipient code or PEC at checkout to receive an electronic invoice; consumers can request an invoice by writing to support@mytiboo.com.

7. Production, shipping and delivery

Unless otherwise agreed, delivery takes place within 30 days of the conclusion of the contract (Article 61 of the Consumer Code), except for delays caused by not receiving the information needed for a Custom Shield. If we fail to deliver within that period, you may give us an appropriate additional period and, if we still fail to deliver, terminate the contract and obtain a refund of the amount paid.

The risk of loss or damage passes to the consumer when the goods are delivered to them or to a third party they designate (Article 63 of the Consumer Code). Please check the parcel on delivery: if it is visibly damaged, accept it “with reservation” and write to us as soon as possible with some photos. Please check your delivery address carefully: the cost of re-shipping due to a wrong address or repeated failed delivery attempts is borne by the buyer.

8. Custom Shield

  1. After payment we will contact you at the email address in your order to collect your idea (description, images or references).
  2. We send you a design proposal. Production starts only after your written approval (email is fine) and takes 7–10 business days from approval, plus the delivery times in section 7.
  3. If within 30 days of our first contact we do not receive your information or approval, despite at least one reminder, we cancel the Custom Shield and refund its price. If the order contains only the Custom Shield, we also refund shipping. If the Custom Shield is part of a bundle, the whole bundle is cancelled and refunded, unless you ask us to replace the Custom Shield with a Shield from the catalogue.
  4. By sending us material you confirm that you hold the necessary rights and that its use does not infringe third-party rights (trademarks, copyright, image rights) or contain unlawful, offensive or discriminatory content. We may refuse a request that does not meet these requirements or is not technically feasible; in that case we refund the Custom Shield (and the bundle, as described in point 3).
  5. A Custom Shield is made to the consumer’s specifications and clearly personalised, so it is excluded from the right of withdrawal (Article 59(1)(c) of the Consumer Code). The legal guarantee for lack of conformity (section 11) still applies.

9. Right of withdrawal (consumers only)

In short: you have 14 days from delivery to withdraw without giving a reason. Return shipping is at your expense. We refund the products and the original standard shipping after receiving and checking the return, within the legal deadlines. Custom Shields are excluded.

Withdrawal period

You may withdraw from the contract without giving any reason within 14 days of the day on which you, or a third party other than the carrier designated by you, take physical possession of the goods. If an order with several items is delivered separately, the period runs from delivery of the last item.

How to withdraw

To exercise the right of withdrawal you must inform us of your decision, before the period expires, by an unequivocal statement sent by email to support@mytiboo.com (or by PEC to byte-srl@pec.it or by post to our registered office). You may use the model withdrawal form, but it is not obligatory. If possible, include your order number or the email address used for the purchase. We will acknowledge receipt by email and send you the return instructions.

Returning the goods

You must send back the goods without undue delay and in any event within 14 days of notifying us of your withdrawal, to: BYTE S.R.L. – Tiboo Returns, Via E. Cravero 44, 10064 Pinerolo (TO), Italy. The deadline is met if you send the goods back before the period has expired.

Exclusions

The right of withdrawal does not apply to Custom Shields made to your specifications (Article 59(1)(c) of the Consumer Code).

10. Returns and refunds

11. Legal guarantee of conformity (consumers)

All products are covered by the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code. BYTE S.R.L. is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery.

Your rights under product liability law are not affected.

12. Business customers (B2B)

If you buy in the course of your business or profession, the Consumer Code provisions do not apply, in particular the right of withdrawal (sections 9–10) and the guarantee in section 11. The warranty against defects under Articles 1490 et seq. of the Italian Civil Code applies: defects must be reported within 8 days of discovery and legal action becomes time-barred one year after delivery. Except in cases of wilful misconduct or gross negligence, the liability of BYTE S.R.L. is limited to the price paid for the product concerned. You are responsible for the accuracy of the billing details you provide. The Court of Turin (Italy) has exclusive jurisdiction over any dispute.

13. Use of the product and liability

Tiboo is an information device: the information it shows depends on data made available by the third-party services it is connected to. BYTE S.R.L. is not responsible for interruptions, changes or inaccuracies of those services, or for decisions taken on the basis of what the device shows. Tiboo is not affiliated with or endorsed by any artificial intelligence provider that may be mentioned. Use the product according to the instructions and keep it out of reach of young children. Nothing in these Terms limits the rights that the law grants to consumers on a mandatory basis.

14. Intellectual property

The Tiboo brand and the texts, images and content of the Site belong to BYTE S.R.L. or their respective owners and may not be reproduced without permission. Buying a product does not transfer any rights in its designs or models.

15. Personal data

The data you provide for your order is processed in accordance with our Privacy Policy.

16. Governing law and disputes

The contract is governed by Italian law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of your country of habitual residence (Article 6 of Regulation (EC) 593/2008). For disputes with consumers, the competent court is that of the consumer’s place of residence or domicile, if located in Italy; consumers living elsewhere in the EU may also bring proceedings in the courts of their country of residence.

For any complaint you can write to support@mytiboo.com and we will try to find a solution together. Consumers may also use the out-of-court dispute resolution procedures provided for by Part V, Title II-bis of the Italian Consumer Code.

17. Changes to these Terms

We may update these Terms at any time. Each order is governed by the version published on the Site when the order was placed.
